Terms of Service

These Terms of Service (the "Terms") are a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and IlmMaps ("IlmMaps," "we," "us," or "our") concerning your access to and use of https://ilmmaps.com and any related products, services, dashboards, digital content, interactive mindmaps, notes, files, features, and resources that refer or link to these Terms (collectively, the "Services").

By accessing or using the Services, creating an account, subscribing to a plan, viewing a free map, or using any IlmMaps content, you agree that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Services.

1. Our Services

IlmMaps provides interactive mindmaps, ready-to-teach notes, educational resources, and related digital content for Islamic students, teachers, and institutions. The Services may include free sample maps, paid maps, subscription-based access, dashboards, account features, email communications, support, and related services.

The Services are intended for users who can lawfully access and use them. If you access the Services from outside Canada, you are responsible for compliance with local laws that may apply to you.

2. Accounts and Eligibility

To access certain parts of the Services, you may need to create an account, provide accurate information, and keep your login credentials secure. You agree that all account information you provide will be true, accurate, current, and complete.

You are responsible for all activity that occurs under your account. You must not share your account credentials, allow another person to use your account, or use another person's account without permission.

You must have the legal capacity to agree to these Terms. If you are using the Services on behalf of an institution, organization, school, company, or other entity, you represent that you have authority to bind that entity to these Terms.

3. Subscription Plans and Access

IlmMaps may offer individual student plans, individual teacher plans, institution plans, free maps, and other access options. Each plan may have different features, usage rights, pricing, seat limits, and access permissions.

Unless expressly stated otherwise, an individual account is for one named user only. Individual accounts may not be shared between multiple users, teachers, students, family members, staff members, or institutions.

IlmMaps may use technical measures to manage access, verify subscription status, limit unauthorized account sharing, protect paid content, and enforce plan limits. These measures may include session controls, login checks, subscription checks, device or browser information, and access logs.

4. Payments, Renewal, Cancellation, and Refunds

Payments and billing

Paid access to the Services requires payment through the payment options made available at checkout. Payments may be processed by third-party payment processors such as Stripe. IlmMaps does not store full credit card numbers on its own servers.

Automatic renewal

Unless otherwise stated at checkout, subscriptions renew automatically at the end of each billing period until cancelled. By subscribing, you authorize IlmMaps and its payment processor to charge the applicable subscription fees, taxes, and other charges to your selected payment method.

Cancellation

You may cancel your subscription according to the cancellation options made available through your account, billing portal, or by contacting admin@ilmmaps.com. Cancellation stops future billing but does not automatically refund past payments.

Refunds

IlmMaps offers a 14-day money-back guarantee for eligible first-time subscribers. If you are not satisfied with your subscription, you may contact admin@ilmmaps.com within 14 days of your first payment to request a refund. Refunds are reviewed and processed to the original payment method where eligible.

After the 14-day money-back guarantee period, subscription payments are generally non-refundable unless required by applicable law or approved by IlmMaps. Refunds, cancellations, and billing questions are further governed by our Refund Policy.

Failed payments

If a payment fails, IlmMaps or its payment processor may retry the payment, notify you, and/or suspend or revoke access if the issue is not resolved. You are responsible for keeping your payment information accurate and up to date.

Price changes

IlmMaps may change prices, plan features, currencies, or billing terms from time to time. Where required, we will provide notice before changes apply to an existing paid subscription.

5. Intellectual Property Rights

IlmMaps owns or licenses the intellectual property rights in the Services, including the website, dashboard, interactive mindmaps, notes, educational content, text, structure, layouts, designs, software, files, graphics, branding, trademarks, service marks, logos, and related materials (collectively, the "Content" and "Marks").

The Content and Marks are protected by copyright, trademark, and other intellectual property laws. Except for the limited access rights expressly granted by these Terms, no rights are transferred to you.

All rights not expressly granted to you are reserved by IlmMaps.

6. Allowed Use of IlmMaps Content

Subject to your compliance with these Terms and your active subscription or access permission, IlmMaps grants you a limited, revocable, non-exclusive, non-transferable right to access and view the Content through the Services according to your plan.

Individual student users may use IlmMaps content for personal study and review. Individual teacher users may use IlmMaps content for personal teaching preparation and classroom use only to the extent permitted by their subscription plan. Institutions may use IlmMaps content only within the seat limits and permissions of the purchased institution plan.

Unless expressly permitted by IlmMaps in writing or clearly allowed under your subscription plan, you may not download, print, export, copy, reproduce, recreate, adapt, distribute, publicly display, livestream, resell, sublicense, or otherwise exploit IlmMaps Content.

7. Prohibited Activities

You may not access or use the Services for any purpose other than the purpose for which IlmMaps makes the Services available. You agree not to:

• Share, resell, redistribute, reproduce, publish, or publicly post IlmMaps Content without permission.
• Copy, export, convert, recreate, or adapt IlmMaps mindmaps, notes, or educational materials into another format without permission.
• Download, scrape, extract, harvest, or systematically retrieve data or Content from the Services without written permission from IlmMaps.
• Share login credentials or allow another person to use your account.
• Use another person's account or create fake, duplicate, or misleading accounts to avoid payment or access limits.
• Share private map links, access tokens, dashboard links, downloaded files, or restricted content with unauthorized users.
• Attempt to bypass, disable, or interfere with subscription gates, session limits, access controls, paywalls, security features, or technical restrictions.
• Use IlmMaps Content to create, train, fine-tune, improve, or build artificial intelligence systems, databases, educational platforms, competing products, or derivative commercial products without written permission.
• Use IlmMaps Content as part of a paid course, commercial program, institutional teaching, public presentation, or public event unless your subscription plan permits that use.
• Use institution access, teacher seats, or student access in a way that exceeds the purchased plan or misrepresents the number of actual users.
• Remove, hide, alter, or obscure any IlmMaps branding, copyright notice, watermark, attribution, or access-control notice.
• Use bots, scrapers, spiders, offline readers, automated tools, or data mining tools to access the Services.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from any part of the Services except where permitted by applicable law.
• Upload, transmit, or introduce viruses, malware, harmful code, spyware, or anything that could damage or interfere with the Services.
• Interfere with, disrupt, overload, or create an undue burden on the Services, servers, networks, or systems connected to the Services.
• Use the Services to harass, abuse, threaten, defraud, mislead, impersonate, or harm another person.
• Use the Services in a way that violates any applicable law, regulation, third-party right, or these Terms.

8. Institution Plans and Seats

Institution plans are limited to the number of seats, teachers, users, or access rights purchased. An institution may not purchase one account and allow multiple users to share it unless that use is expressly allowed under the plan.

Each seat is intended for one authorized user unless IlmMaps states otherwise in writing. Institutions are responsible for ensuring that their administrators, teachers, staff, and users comply with these Terms.

IlmMaps may suspend, revoke, or limit institution access if we reasonably believe an institution is sharing accounts, exceeding seat limits, misrepresenting usage, or using the Services outside the purchased plan.

9. Free Maps and Email Access

IlmMaps may offer free maps, previews, samples, or other free content. Free access may require an email submission, account creation, or other access step. Free maps remain IlmMaps Content and are still protected by these Terms.

Providing access to free content does not give you permission to copy, redistribute, resell, or publicly post that content unless IlmMaps clearly allows it in writing.

10. Feedback and Submissions

The Services are not intended to operate as a public posting platform. However, you may send us feedback, questions, suggestions, testimonials, support messages, book suggestions, or other communications (collectively, "Submissions").

By sending Submissions to IlmMaps, you grant IlmMaps a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, translate, distribute, and display those Submissions for lawful business purposes, including improving the Services, developing new features, creating new maps, responding to support requests, and marketing the Services.

You represent that your Submissions do not violate the rights of any third party and do not contain unlawful, confidential, misleading, harmful, abusive, defamatory, or infringing material.

11. Services Management

We reserve the right, but not the obligation, to monitor the Services for violations of these Terms, manage access, restrict or revoke access, remove or disable content, investigate suspected abuse, enforce plan limits, and take appropriate action to protect IlmMaps, its users, and its Content.

12. Term and Termination

These Terms remain in effect while you use the Services. We may suspend, restrict, or terminate your access to the Services if you violate these Terms, fail to pay, share accounts, misuse institution seats, attempt to bypass access controls, infringe our rights, or engage in conduct that may harm IlmMaps, its users, or the Services.

If your account is suspended or terminated, you may not create a new account to bypass the suspension or termination without our written permission. Termination does not affect any rights or obligations that, by their nature, should survive termination, including intellectual property rights, payment obligations, prohibited use rules, disclaimers, limitations of liability, indemnification, and dispute provisions.

13. Modifications and Interruptions

IlmMaps may update, correct, improve, modify, reorganize, remove, or discontinue parts of the Services or Content from time to time. We may also change or update descriptions, pricing, availability, maps, notes, features, and other information.

We cannot guarantee that the Services will always be available without interruption, delay, error, or downtime. We may experience technical issues, security issues, maintenance needs, or third-party service interruptions.

14. Educational and Religious Disclaimer

IlmMaps content is provided for educational support, study, review, teaching preparation, and classroom assistance. IlmMaps content should not be treated as a replacement for direct study with qualified teachers.

IlmMaps content may summarize, organize, or explain Islamic texts, fiqh discussions, scholarly positions, or educational material. It should not be treated as a formal fatwa, personal legal ruling, religious ruling for every individual circumstance, or substitute for asking qualified scholars about specific cases.

We work to provide useful and accurate educational resources, but we do not guarantee that every explanation, summary, note, translation, formatting choice, or map structure is complete, error-free, or suitable for every curriculum, institution, teacher, student, madhhab, or personal circumstance.

15. General Disclaimer

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, IlmMaps disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not warrant that the Services will be uninterrupted, secure, error-free, or free from harmful components. We do not assume responsibility for third-party websites, services, payment processors, platforms, links, or tools connected to or used with the Services.

16. Limitations of Liability

To the fullest extent permitted by law, IlmMaps and its owners, directors, employees, contractors, agents, affiliates, and partners will not be liable for indirect, incidental, consequential, exemplary, special, punitive, or similar damages, including loss of profits, revenue, data, goodwill, business opportunity, or educational outcome arising from or related to your use of the Services.

To the fullest extent permitted by law, IlmMaps' total liability to you for any claim arising from or related to the Services will be limited to the lesser of: (1) the amount you paid to IlmMaps in the six months before the claim arose; or (2) $500 CAD.

Some laws do not allow certain limitations or exclusions. In those cases, the above limitations apply only to the maximum extent permitted by applicable law.

17. Indemnification

You agree to defend, indemnify, and hold harmless IlmMaps and its owners, directors, employees, contractors, agents, affiliates, and partners from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising from or related to your use of the Services, your violation of these Terms, your misuse of IlmMaps Content, your violation of another person's rights, your account sharing, your institution's misuse of seats, or your violation of applicable law.

18. Privacy and User Data

Your use of the Services is also governed by our Privacy Policy and Cookie Policy. These policies explain how IlmMaps may collect, use, store, and process information related to the Services.

You are responsible for maintaining the confidentiality of your account credentials and for ensuring that your account information remains accurate and up to date.

19. Electronic Communications

Visiting the Services, creating an account, subscribing, submitting forms, and sending emails to us constitute electronic communications. You consent to receive electronic communications from us, including account notices, subscription notices, policy updates, transactional emails, and, where permitted, marketing communications.

You may unsubscribe from marketing emails using the unsubscribe options provided in those emails. Transactional or account-related emails may still be sent when needed to operate your account, process payments, provide access, or comply with legal obligations.

20. Governing Law and Disputes

These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada, without regard to conflict of law principles.

Before bringing a formal claim, you agree to contact us at admin@ilmmaps.com and attempt to resolve the dispute informally. We will also attempt to resolve disputes in good faith.

Subject to any mandatory consumer protection rights that apply to you, disputes arising from or related to these Terms or the Services may be brought before the competent courts of Quebec, Canada.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.

21. Miscellaneous

These Terms, together with any policies or rules posted by IlmMaps, constitute the entire agreement between you and IlmMaps regarding the Services. Our failure to enforce any right or provision of these Terms does not waive that right or provision.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

We may assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, restructuring, or operation of law. You may not assign your rights or obligations under these Terms without our written permission.
